Stewart Waithanji Faces Felony DUI Hit-and-Run Charges after Killing Driver Richard Frost in Costa Mesa

 
COSTA MESA, CA (April 14, 2021) – Richard Frost died in a DUI hit-and-run in Costa Mesa Saturday afternoon, April 10.
 
The incident happened around 4:00 p.m. on Newport Boulevard, just south of 17th Street. According to Costa Mesa police, the 74-year-old Newport Beach resident was driving a vehicle when he collided with a Chevrolet Malibu. He then got out of his car and tried to stop the Malibu from driving away.
 
The driver of the Malibu, identified as 28-year-old Stewart Leacky Waithanji of Costa Mesa, ran over Frost and fled the scene.
 
Responding paramedics rushed Frost to a local hospital, where the victim succumbed to his injuries.
 
Meanwhile, police located Waithanji at a Los Alamitos bar. They determined that he was driving under the influence of alcohol at the time of the crash. They also found out that the suspect was convicted in May and August of 2016 and in February 2018 in Iowa of DUI.
 
As a result, police charged him with single felony counts each of second-degree murder, DUI, and driving with a blood alcohol level of .08% or more.
 
Police also arrested Waithanji’s female passenger on suspicion of being an accessory to a crime.
