How Can a Lyft or Uber Accident Lawyer Help Me?
Being involved in an Uber or Lyft accident isn’t like the average Southern California motor vehicle accident case. Between the involvement of multiple insurance policies, company protocols, and contracted rideshare drivers, attempting to sue juggernauts like Uber and Lyft may not end successfully. This is where an experienced Uber and Lyft accident attorney can help.
A lawyer can help Uber and Lyft accident victims take on aggressive rideshare companies who will try to shirk responsibility. An attorney with experience handling rideshare accident cases will know the ins and outs of each company’s policy, as well as the local laws and violations. Additionally, injuries sustained in a car accident can be catastrophic and life-changing. The cost of treatment, doctor visits, and physical therapy can add up. Victims of ridesharing accidents should not be responsible to cover these costs. An attorney can help you recover losses such as medical expenses, property damage, and pain and suffering.
Under California’s statute of limitations, accident victims have two years to file a personal injury claim. After you’ve received medical attention, reach out to a personal injury attorney who can help you file a claim against the right at-fault party.
Can I Recover Compensation for a Rideshare Accident?
Because Uber and Lyft accidents are so complex, your settlement amount will vary from case to case. When filing a personal injury claim, you can pursue compensation for:
- Current and future medical bills
- Lost wages from missing work
- Physical pain and suffering
- Disabilities or disfigurement
- Emotional trauma or ongoing mental distress
- Damage to personal property
- Wrongful death
Navigating legal proceedings for rideshare accidents is complex. To gain clarity, it’s best to consult with an experienced Victorville Lyft and Uber accident attorney. Daniel Kim and his legal team will assess your case and advise on the best course of action. Contact our Victorville personal injury lawyer to learn how we can help.
What Are Common Causes of Rideshare Accidents?
Uber and Lyft do not publicly disclose accidents involving their vehicles or drivers, making it difficult to determine the causes. However, it’s safe to assume that a rideshare accident happens for the same reasons that most auto accidents do. Below are some of the common causes of accidents involving an Uber or Lyft vehicle:
- Speeding
- Fatigue
- Distraction
- Talking to or scanning for passengers
- Unfamiliar roads
- Pulling over at unsafe locations
- Failure to obey traffic laws
- Intoxication
Our Victorville law firm specializes in Uber and Lyft accidents, and we are available to answer any questions you may have 24 hours a day, 7 days a week. Schedule your complimentary case evaluation today.
Does Lyft or Uber Compensate for Accidents?
It depends. While both Lyft and Uber provide similar insurance policies in the event of a rideshare accident, they go into effect depending on the circumstances. If the rideshare driver is found at fault, the insurance coverage is broken down into three “periods.”
Period 1
If the Uber or Lyft driver’s app is off or not in use, rideshare companies do not provide liability coverage. Only the driver’s personal insurance company policy applies. In California, it is required by law that each driver maintain a minimum of insurance coverage as follows:
- $15,000 bodily injury per person
- $30,000 bodily injury per accident
- $5,000 property damage per accident occurred
Period 2
If the Uber and Lyft driver has their app open but has not accepted a ride, they might be driving around and cause a collision. In this case, both the driver’s personal insurance policy and the rideshare’s insurance company will cover an injured third party. If the driver’s coverage is insufficient, Lyft and Uber maintain third-party liability insurance: $50,000 in injury liability per person, $100,000 in total liability per crash, and $25,000 in property damage liability per crash.
Period 3
When an Uber and Lyft driver has accepted a ride or is en route to pick up a passenger, passengers and third parties are protected by the rideshare’s full coverage:
- $1 million in third-party liability coverage
- Uninsured/underinsured motorist bodily injury and/or first-party injury insurance
- Contingent comprehensive and collision. Uber and Lyft charge a $2,500 deductible before this coverage begins.
Is Lyft or Uber Liable for Their Drivers’ Negligence?
The rideshare company is rarely found liable in accidents. This is due to the fact that Uber and Lyft drivers are considered independent contractors and not regular full-time employees. However, because rideshares are considered “transportation network companies” under California law, they are required to maintain insurance coverage for passengers and third parties in the event of a Lyft or Uber accident.
As is the case with a regular car accident, you must prove that the rideshare driver acted negligently and caused the accident. To do this, you must show:
- The driver had a duty of care to drive safely and obey traffic laws
- The driver breached his or her duty of care
- The driver’s breach caused the accident
- The accident caused the victim damages
If you are a passenger in a rideshare accident, negligence is very easy to prove. However, if you get into a collision with an Uber or Lyft driver, you may hold some responsibility. Fortunately, California abides by comparative negligence law, which allows the injured victim to file a claim even if they are found partially at fault.
What Should I Do As a Passenger in a Rideshare Accident?
If you are in a rideshare accident as a passenger, it’s always best to call 911 and wait for the police to arrive. After they create a police report, make sure to obtain a copy of the report for your records. Here are a few more important steps you can take to protect your right to compensation:
- Seek immediate medical attention: Get checked out from your primary care physician or urgent care, no matter how minor your injuries may seem. Certain injuries like whiplash do not appear immediately but may cause complications further on. Medical records will also prove very useful if you decide to file a claim later on.
- Obtain evidence at the scene: Write down the name, address and phone number of the rideshare driver and the other driver involved in the accident. It’s also good to get the contact information of any witnesses who saw what happened.
- Take photos: If you are able, take photos of the accident scene, including vehicle damage, road and weather conditions, and physical injuries.
- Submit a crash report to the rideshare company: Both Uber and Lyft provide assistance 24/7. You should still report the crash to Uber or Lyft when you are able to do so. You can find Uber’s report here and Lyft’s report here.
- Contact an Uber/Lyft accident attorney: Remember that anything you say can and will be used in a court of law against you. It’s best not to say anything without legal representation present. Contact an experienced accident attorney as soon as you can.
Rideshare accidents are more complex than regular car accidents. You can benefit from legal advice and how to proceed in a free consultation with a licensed attorney.
