NORTH COUNTY, CA (August 17, 2021) – A passenger died in a DUI accident on 5 Freeway Sunday morning.

The accident happened around 8:50 p.m. on August 15, just north of Las Pulgas Road. According to the California Highway Patrol, a 2011 Subaru Outback veered across two lanes and went off the side of the freeway down into an embankment. It then struck a tree and overturned.

As a result, a 27-year-old male passenger from Dana Point was thrown from the car and died at the scene. Investigators believe he was not wearing a seat belt.

The 25-year-old driver, also a Dana Point resident, was in critical condition. Two other passengers, a 22-year-old woman and a 25-year-old man, sustained minor injuries.

Police later arrested the driver on suspicion of driving under the influence of alcohol, CHP officials said.
