Big Rig Boxes in DUI Driver, Triggers Fatal Truck Accident on 5 Freeway in Stanislaus County

 
STANISLAUS COUNTY, CA (April 22, 2021) – A truck driver died after another a big rig driver attempted to stop a possible DUI drier on 5 Freeway in Stanislaus County on April 21.
 
The accident happened just after 1:00 a.m., along the northbound side of the 5 Freeway. According to the California Highway Patrol, a big rig driver spotted a red sedan swerving across both lanes of traffic south of Howard Road.
 
According to police, the big rig driver used his vehicle to boxed in the potential DUI driver to stop the car from proceeding. Two other trucks came to a complete stop behind the suspected DUI driver and the truck boxing it in.
 
The driver of a third big rig, 41-year-old Elpidio Ramirez Tovar from Five Points in Fresno County, failed to stop. He rear ended the big rig in front of him, which pushed into the big rig in front of it.
 
Tovar ejected from the cab. He landed on the east shoulder of the highway and died at the scene.
 
It is unknown if Tovar wore a seat belt and the speed remains under investigation. However, there is no indication the initial big rig called 911 to report the DUI driver, according to police.
 
The driver of the big rig Tovar rear ended suffered minor injuries. However, the driver of the big rig in front of him did not suffer injuries.
 
Police arrested the driver of the red sedan, 40 year-old Daniel Avilan-Tirado of Stockton, on suspicion of driving under the influence of drugs.
